Rules & Regs

The Rules and Regulations pertain to the use of the units and common elements of the facility, and are intended as the means for creating and maintaining a Community where an exceptional quality of living should prevail, and where property values should continue to appreciate.   

We have briefly listed the restrictions contained in the By-Laws and Rules & Regulations below, but this list does not represent all restrictions as set forth in the Condominium Governing Documents.  This will attempt to highlight those provisions that are particularly important for successful condominium living and those most often abused.  For a complete understanding of the Association's Governing Documents, please refer to the By-Laws and Rules & Regulations contained in the Condominium Documents. General Rules and Regulations

1- Common Area Storage

Bicycles, scooters, baby carriages or similar vehicles or toys or other personal objects should not be left unattended in any part of the common areas.  Residents should not build, plant or maintain anything upon, in, over or under the Common Elements without prior consent of the Board.

2- Pets

Animals of any kind are not permitted to be kept in any unit or anywhere else upon the property.  This includes visiting pets.

3-Commercial Interests

Units may be used solely as residences. No commercial business may be conducted from these units.  No portion of a unit other than an entire unit may be rented and no transient tenants may be accommodated therein.

4- Damage to Common Elements

Damages to the Common or Limited Common Elements caused by a unit owner, or actions of their minor children, their tenants or their guests shall be the responsibility of the unit owner.

5- Laundry

Unit owners shall not install poles and/or lines for drying of laundry outside their units.  Nor shall laundry be hung from patio/ balconies or fences.

6- Nuisances

Residents are not permitted to create any nuisance such as excessive noises, odors or vibrations which could be a source of annoyance to, or which would interfere with the peaceful possession, etc. Residents will not sweep, drop, shake or throw from their units or from doors or windows any dirt or other substance.

7- Awnings, Air Conditioners, Fans

Awnings, window guards, window boxes, ventilators, fans or window air conditioning devices cannot be used, affixed to or set up within a building.

8- Signs, Notices, etc.

Signs, notices, advertisements, flags, banners, posters and the like are not permitted at any window or other part of any building. The Board has established policy allowing "Open House" signs only on the day of the open house.

9- Local Restrictions

Residents are expected to comply with all valid laws, zoning ordinances and regulations of all governmental agencies having jurisdiction.

10- Exterior Modifications

Unit owners are not permitted to build, plant or maintain any matter in, over or under the Common or Limited Common Elements, paint or alter the exterior of their units, including windows and doors, without prior written consent of the Board.

11- Waterbeds

The use or maintenance of a waterbed in any Unit is prohibited.

12- Vehicle Storage and Parking Regulations

- Commercial vehicles, buses, trailers, or boats may not be parked on the property.

- Repair or dead storage of vehicles, boats or equipment is not permitted on condominium property.

- The Association has the right to remove vehicles or equipment from the property after 24 hours notice.

- Passenger motor vehicles must be parked only in designated areas (within designated spaces in courts, garages, and driveways).

13- Traffic Regulations

All residents, their employees, visitors and family members are asked to obey the following traffic regulations to assure  the safety, comfort and convenience of all residents:

                        1.  25 mph speed limit along Heritage Blvd.

                        2.  Acknowledge Stop Signs at all courts entering onto Heritage Blvd.

                        3.  Stay to the right around both circles.

                        4.  Respect handicapped spaces.

                        5.  Avoid blowing horns except to prevent an accident. 

Canal Pointe has received Title 39 designation from West Windsor Township, which will permit the Township Police to enforce moving violations within the Community.

14- Restriction of Flammable Materials

Residents are not permitted to bring into their unit any inflammable oil or fluid, such as gasoline, kerosene, carbon tetrachloride, naphtha or benzene or explosives, fireworks or articles deemed extra-hazardous to life, limb or property, or any other item that would increase the fire rating of the Unit.

15- Association's Rights

The Association or Managing Agent and any contractor authorized by the Association or Manager, may enter any unit at a reasonable hour of the day, upon pre-arrangement with the unit owner.  In the event of an emergency, the Association retains the right to access a unit immediately.

16- Repairs to Unit

Except in an emergency, work in any unit is not permitted between the hours of 6:00 PM and 8:00 AM on Saturday, Sunday or Legal Holidays if such work is likely to disturb the occupants of another unit.

17- Soliciting

Soliciting is not permitted within the Community unless authorized by the Board.  Violations of this prohibition are considered trespassing and should be reported to the Association office or the West Windsor Police Department.

18- Garbage Disposal at Townhomes & Patio Homes

- All trash for curbside pick-up must be placed at the curb in closed receptacles the evening before or the morning of the pick-up.

- Trash and recycling receptacles must be brought in from the curb on the evening of scheduled pick up.

19- Window Coverings

- The portion of the window covering facing out is to be of a neutral tone and window coverings must be intended for that purpose; sheets, towels or other temporary coverings are not permitted.

20- Holiday Decorations

The Architecture Committee establishes guidelines each year for holiday decorations during the Christmas and Hanukkah season.  Please refer to the Association Newsletter for guidelines when you receive it in November.

21- Barbecue Grills

The use of barbecue grills is regulated by the State of New Jersey and West Windsor

Township.  The State Fire Prevention Code, effective March 2, 1992 prohibits the storage or use of propane barbecue grills on porches, balconies or other portions of the building within five feet of any combustible exterior wall or within five feet vertically or horizontally of an opening in any wall.  This provision would prohibit storage and use at all garden home units.  Townhome and patio home residents are asked to comply with the five-foot requirement if storing or using a propane grill.

Additionally, West Windsor Township's ordinance for barbecue grills is as follows:

F-4005.2 - Barbecue Grills:  No charcoal cooker brazier, hibachi, or grill, any gasoline or other flammable liquid, or liquefied petroleum gas-fired stove or similar device shall be ignited or used on the balconies of any apartment building,  condominium, townhouse, or similar occupancy.  Exception:  One-family and  two-family dwellings.

The Fire Marshal will allow usage at the townhomes as long as cooking equipment is kept at least five feet away from any combustible wall.

The State of NJ and West Windsor Township will be enforcing these prohibitions.  To avoid the possibility of severe penalties and to assure the soundness and safety of your unit and the units surrounding you, please abide by these prohibitions.

22.- Displaying the American Flag

The displaying of the American flag will be permitted:

  1. The flag cannot be larger than 3x5.
  2. It can be attached only to a wooden surface.
  3. Attachments must be the standard hardware design for hanging a flag.
  4. The location of the flag cannot block someone else?s view from their unit, cannot block any thoroughfare, and cannot interfere in any way with any other unit as noted in Article VI, Section 7 (c).
  5. Upon removal of the flag attachment, the unit owner will be responsible to repair any damage that may have resulted.
  6. It may be necessary to have the flag and attachments removed to allow the Association to perform maintenance to the common elements.  The unit owner may be responsible for this removal.
  7. The Association?s Board of Trustees or designated representative reserves the right to review the location of any flag ad require removal if installation is, in their discretion, a detriment to the aesthetics of the Community, poses a safety issue, or interferes with another unit.
  8. Resident is expected to follow all laws and standard policies governing the proper display of the American flag.  Any disrespectful display will be determined by the Board of Trustees and may require immediate removal.
  9. This policy can be revoked at any time at the discretion of the Board of Trustees.

23- Garden Home Patio/Balcony Usage

In an effort to preserve the aesthetics of the community, as well as the architectural and structural integrity of the patio/balcony systems within the garden home section of Canal Pointe, the Board established the following guidelines, which were adopted as policy.  This policy also serves to further define the existing document provision within the By-Laws, specifically, ARTICLE VI., SECTION 7 (i) "No Unit Owner shall build, plant or maintain any matter or thing upon, in, over or under the Common Elements or Limited Common Elements without the prior written consent of the Board unless permitted by the Rules and Regulations;....."

1.   Nothing shall be nailed, screwed, or attached in any manner to any portion of the rails, posts, floor boards, joists, beams, etc.

2.      Only patio related furniture and patio related accessories shall be permitted to be placed on the patio/balcony, i.e., patio furniture, free standing plants, etc.

3.      Nothing shall be hung from the rail system except Association approved planter boxes/hangers.  All hangers must be rubber coated to protect the rail from damage. 

4.   No items, such as flower pots shall be placed or be allowed to rest on the top surface of the rail.

Number 17, Paragraph 2 of the Master Deed provides that the Unit Owner shall pay for any damage to the Common or Limited Common Elements due to the negligent act or omission of a Unit Owner or other authorized occupant.  Therefore, if any damage is caused to the railing and/or patio balcony system, repairs  will be made by the Association at the sole expense of the unit owner.  This policy was adopted by the Board of Trustees at their meeting on January 8, 1991.

24- Garden Home Flooring

The Canal Pointe By-Laws, Article VI, Section 7 (j) states:

"No hardwood or ceramic flooring shall be installed in the second and third floor Garden Home Units except in the bathrooms."

The Board of Trustees, by resolution, passed at a meeting held on September 5, 2000, interpreted this By-Law provision.  The resolution states:

"To agree with MARC, to follow the by-laws that no hardwood floors would be permitted at the second and third floor Units.  Additionally, the Board agreed that an interpretation would read as follows:  'All floor coverings installed at the 2nd and 3rd floor Units must be similar to that which was offered by the developer at the time of construction, specifically indoor wall-to-wall carpeting with padding in all rooms, except the bathroom, kitchen and utility room areas.'"

25- Abuse of Personnel

Any person who shall fail to adhere to the instructions, verbally or physically abuse or threaten to abuse, disrupt or interfere with the authorized functions of any agent or employee of the Canal Pointe Condominium Association shall be in violation of the rules and regulations of the Canal Pointe Condominium Association and shall be subject to fines and/or penalties in accordance with Article 5, Section 2 of the By-laws.
